Who owns bridges over railway?
Section 116(1) of the Transport Act 1968 (TrA 1968) says that the highway carried by the bridge is transferred, not the bridge itself. Note however, that TrA 1968, s 116(6) says that the bridge itself remains the property of the owner (ie the railway company).
